WanderStamp — Proof-of-Presence Digital Passport

1. Acceptance of Terms

By downloading, installing, or using the WanderStamp application ("the App") or any related services, you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

WanderStamp is a digital passport application that allows users to collect proof-of-presence stamps at physical locations worldwide. Each stamp is a CashToken NFT minted on the Bitcoin Cash blockchain, verified by NFC hardware authentication and GPS location data.

3. User Accounts and Wallets

• The App automatically creates a self-custodial Bitcoin Cash wallet on your device.
• You are solely responsible for safeguarding your 12-word seed phrase. We cannot recover lost seed phrases.
• You are responsible for all activity conducted through your wallet.
• We do not hold, control, or have access to your wallet, seed phrase, or NFT stamps.

4. Stamp Collection

• Stamps can only be collected at authorized WanderStamp checkpoints with valid NFC cards.
• You must be physically present at the checkpoint location to collect a stamp. Any attempt to spoof location data or NFC authentication is prohibited.
• Stamp collection is limited to one stamp per location per wallet within a specified time period.
• Stamps are minted as immutable CashToken NFTs on the Bitcoin Cash blockchain and cannot be altered or deleted once created.

5. NFT Ownership

• Stamps collected through the App are your property. You may hold, transfer, trade, or sell them.
• We make no guarantees regarding the monetary value of any stamp.
• Ownership of a stamp NFT does not grant any intellectual property rights to the WanderStamp brand, designs, or trademarks.

6. Blockchain Data

• Data recorded on the Bitcoin Cash blockchain (including GPS coordinates, timestamps, and wallet addresses) is permanent and publicly accessible.
• You acknowledge and consent to this permanent recording when collecting stamps.
• We are not responsible for blockchain network fees, delays, or disruptions.

7. For Businesses (Shop Accounts)

• Businesses may purchase WanderStamp NFC cards to offer stamp checkpoints at their locations.
• Cards are sold with a set number of stamp credits. Once credits are depleted, additional credits may be purchased.
• Businesses are responsible for the physical security of their NFC cards.
• WanderStamp reserves the right to revoke cards or suspend shop accounts that are found to be misused.
• Stamp designs (shape, location name, and metadata) are configured by the business and must be accurate and not misleading.

8. Prohibited Conduct

You agree not to:

• Attempt to forge, spoof, or fabricate NFC authentication or GPS location data
• Clone, duplicate, or tamper with WanderStamp NFC cards
• Use the App for any illegal purpose
• Attempt to disrupt, hack, or compromise the App, API, or blockchain infrastructure
• Misrepresent your identity or location

9. Intellectual Property

The WanderStamp name, logo, stamp designs, app design, and all related intellectual property are owned by Digital Art and Currency Group. You may not use our branding without written permission.

10. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, error-free operation, or that stamps will maintain any particular value. The Bitcoin Cash blockchain operates independently and we are not responsible for its performance.

11. Limitation of Liability

To the maximum extent permitted by law, WanderStamp and Digital Art and Currency Group shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of stamps, wallet access, or cryptocurrency value.

12. Modifications

We reserve the right to modify these terms at any time. Continued use of the App after changes constitutes acceptance. The latest version will always be available at wanderstamp.io/terms.

13. Termination

You may stop using the App at any time. We may suspend access to our servers for violations of these terms. Your stamps remain in your wallet regardless — they exist on the blockchain independently of our service.

14. Governing Law

These terms are governed by the laws of the State of Michigan, United States.
